Barcode Generator Tool provides free online services for generating various types of barcodes, including but not limited to EAN-13, EAN-8, UPC, CODE128, CODE39, ITF-14, and QR codes. Our Services allow users to create, customize, and download barcode images for personal or business use.

Service Availability

We strive to ensure that our Services are available 24 hours a day, 7 days a week. However, we cannot guarantee uninterrupted access to our Services. We reserve the right to suspend or restrict access to some or all of our Services for maintenance, security, or other reasons, with or without prior notice.

Free Service

Our barcode generation services are currently provided free of charge. However, we reserve the right to modify or charge for the Services (or any part thereof) in the future. We will notify users of any changes to the fee structure before they take effect.

• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
• Create or transmit unwanted electronic communications such as "spam" to other users
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Intentionally or unintentionally violate any applicable local, state, national, or international law
• Create barcodes that could cause harm to consumers or businesses, such as counterfeit product codes

5. Intellectual Property Rights

Our Intellectual Property

The Services and their original content, features, and functionality are owned by Barcode Generator Tool and are protected by copyright, trademark, and other intellectual property laws. The look and feel of our website, including all page headers, custom graphics, button icons, and scripts, is the proprietary property of Barcode Generator Tool and may not be copied, imitated, or used, in whole or in part, without our prior written permission.

Trademarks

All trademarks, service marks, and trade names used on the Services are the property of their respective owners. 7. Barcode Usage and Compliance

Industry Standards Compliance

While we strive to generate barcodes that comply with relevant industry standards (such as GS1 specifications), it is your responsibility to ensure that the barcodes you generate using our Services meet the specific requirements for your intended use. This includes, but is not limited to, ensuring:

• The correct barcode type is selected for your application
• The barcode data follows the required format and structure
• The physical dimensions and print quality are appropriate for scanning environments
• You have the necessary permissions or registrations (e.g., GS1 company prefix) to use certain barcode types for commercial purposes

Official Registration Requirements

Some barcode types, particularly those used in retail environments (such as UPC, EAN-13, and EAN-8), require official registration with GS1 or another relevant issuing organization for legitimate commercial use. Our Services allow you to generate these barcode types without verification of registration, but it is your responsibility to obtain the appropriate registrations or permissions before using such barcodes commercially.

Scanning Reliability

The scanning reliability of generated barcodes depends on various factors, including the quality of printing, scanning equipment, environmental conditions, and proper implementation. We do not guarantee that the barcodes generated using our Services will scan reliably in all situations or with all scanning equipment. We recommend testing generated barcodes in your specific environment before deploying them at scale.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantees

We do not warrant that:

• The Services will meet your specific requirements
• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained through the Services will meet your expectations
• Any errors in the Services will be corrected

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BARCODE GENERATOR TOOL, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

UNDER NO CIRCUMSTANCES WILL OUR AGGREGATE LIABILITY, IN ANY FORM OF ACTION WHATSOEVER IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE SERVICES, EXCEED THE GREATER OF (1) THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICES DURING THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (2) $100 USD.

THE LIMITATIONS OF THIS SECTION WILL APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

Specific Barcode Liability

Without limiting the foregoing, we specifically disclaim all liability for:

• Any economic losses (including loss of revenues, profits, contracts, business, or anticipated savings)
• Any loss of goodwill or reputation
• Any special, indirect, or consequential losses
• Any issues arising from the use of barcodes generated using our Services, including but not limited to scanning failures, incorrect data encoding, or noncompliance with industry standards
• Any damages resulting from the failure of any product or system using barcodes generated by our Services

10. Indemnification

You agree to defend, indemnify, and hold harmless Barcode Generator Tool, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User Content
• Your use of the Services, including but not limited to your use of barcodes generated with our Services
• Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
• Any claim that your User Content or the use of barcodes generated by our Services caused damage to a third party

This defense and indemnification obligation will survive these Terms and your use of the Services.

11. Term and Termination

Term

These Terms shall remain in full force and effect while you use the Services.

Termination by You

You may terminate your use of the Services at any time by discontinuing your use of our website and services.

Termination by Us

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Effect of Termination

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Modifications to Terms or Services

Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

Modifications to Services

We reserve the right at any time to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

13. Governing Law and Dispute Resolution

Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in San Francisco, California, using the English language in accordance with the Arbitration Rules and Procedures of JAMS then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.

Class Action Waiver

Any arbitration under these Terms will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. YOU AND BARCODE GENERATOR TOOL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

14. Miscellaneous Provisions

Entire Agreement

These Terms constitute the entire agreement between you and Barcode Generator Tool regarding your use of the Services and supersede all prior and contemporaneous written or oral agreements between you and Barcode Generator Tool.

Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

Notice

We may provide notices to you via email, regular mail, or postings on our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control.

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
